The Kathmandu District Court has found cricketer Sandeep Lamichhane guilty in the minor rape case. After the final hearing of the argument that has been going on for a week, the Ijalas of District Court Judge Shishirraj Dhakal found him guilty.
On the night of August 6, 2079, a minor had filed a complaint at the Gaushala Police Circle on August 21 saying that Lamichhane had forcibly raped her. Lamichhane was arrested by the police on October 20 from Tribhuvan International Airport.
The case was registered in District Court, Kathmandu on 14th October 2079 and the verdict was given today. Although the District Court sent him to judicial custody, the High Court, Patan, released him. After the Supreme Court upheld the order of the High Court, Lamichhane was fighting the case outside the prison.
In the case of more than 3 years of imprisonment, a separate hearing is required to determine the crime, so it is not specified how many years of imprisonment he will be sentenced to. For that, the hearing will be held on 31st of January. The hearing in Judge Dhakal’s courtroom will determine imprisonment, fines and compensation for Lamichhane.
The National Criminal Code, 2074 Said That
Under Section 18 of the National Criminal Code 2074, crimes related to criminal activities have been mentioned. It is mentioned in section 219 of the Code that there should be no forced marriage. Section 219 of the National Criminal Code, 2074, sub-section 3, provides that a person who commits coercion may be punished with imprisonment depending on the circumstances and age of the woman.
